Amber operates a small farm in her state. She sells genetically modified (GM) fruits and vegetables in her state and in surrounding states. An inspector from the US Department of Agriculture informs Amber it is illegal to sell GM products in the United States for human consumption. Amber then successfully lobbies her state legislature to enact a law allowing her to sell her crops within the state. Will Amber’s Statute protect Amber from prosecution by the USDA? Why or why not?
